Bonjour à tous ! Ma compagne s'est vu refusé ses indemnités d'arrêt maladie. Voici sa situation :
Début 2024 (fin janvier, début février) elle attrape une pneumonie atypique qui met du temps à être diagnostiqué. Résultat : après avoir fait une radio ET un IRM elle finit en arrêt maladie une semaine, prononcé par un premier médecin. Cependant sa situation ne s'améliore pas et elle est contrainte d'être arrêté une semaine supplémentaire par un autre médecin. A chaque fois elle transmet les arrêts maladies dans les 48h en les déposant dans une urne de collecte au siège de l'assurance maladie, le problème c'est qu'elle n'a pas fait de copies et n'en a pas de preuves.
Après un certain temps, nous nous retrouvons en mars 2024 et elle n'a toujours pas reçu ses indemnités. Trouvant cela étrange, elle prend rdv avec une conseillère. Elle a été en mesure de fournir les volets 3 de l'arrêt (ceux fournis à l'entreprise) qui sont littéralement des copie carbone des volets 1 mais la conseillère lui explique qu'ils n'ont jamais reçu les arrêt et qu'il faudrait qu'elle fournisse des duplicata des arrêts. Vu qu'on avait pas de copies, on a retrouvé les deux médecins qui nous ont refait les arrêts de travail. Le temps de les retrouver et de renvoyer le tout, on se retrouve à envoyer ça le 17 septembre 2024, ils accusent la réception des duplicata.
Une semaine après, ils nous disent que comme cela n'a pas été reçu dans les 48h, ils ne peuvent pas le prendre en compte mais que nous pouvons toujours faire parvenir un recours par recommandé. C'est ce que nous faisons en leur réexpliquons toute cette histoire.
Aujourd'hui nous recevons la réponse à ce recours, voici ce qui lui est répondu :
- on lui rappelle au conditionnel qu'elle leur "aurait" envoyé les arrêts dans les délai, j'imagine que c'est pour sous-entendre qu'on ne peut pas le prouver. Est-ce que la transmission du volet 3 à son travail, qui peut attester l'avoir reçu dans les bon délai, est suffisante pour soutenir le contraire ?
- on lui rappelle qu'elle doit fournir les arrêts dans les 48h, ce qui a été fait mais nous ne pouvons pas le prouver et c'est sur ça qu'ils insistent, à quel point cette règle est légitime dans notre cas ?
- Ensuite, le courrier cite l'article R323-12 du code de la sécurité sociale : "la caisse est fondée à refuser le bénéfice des indemnités journalières afférentes à la période pendant laquelle le contrôle a été rendu impossible". Ce que je crois comprendre c'est que finalement on lui refuse car ils n'ont pas pu contrôler qu'elle était bien malade durant la période d'arrêt car il ne considère QUE l'envoi des duplicata. Mais nous disposons toujours des résultats de la radio et de l’IRM daté, cela peut-il constituer une preuve de sa maladie (en plus des duplicata des arrêts, écrits par les médecins) ?
- Enfin, le fait que les duplicata aient été reçu dans un même pli après les fameux 48h semble être avancé comme preuve du fait que nous n’avons pas respecté les délai. L’hypothèse que nous les ayons envoyé dans les temps est ignoré seul l’envoi de ces duplicata est pris en compte. Donc on ne peut pas faire valoir le fait qu’on les aurait envoyé dans les temps en premier ? Pourquoi lui a-t-on demandé d’envoyer les duplicata bien après les 48h si ce n’est pas valable ?

This song is such a masterpiece. I know it’s often considered one of the weaker tracks on AMSP, but I actually think it’s an incredible song. I’m going through a lot of life changes at the moment and some of the lyrics really speak to me: “Through an open doorway, across a street, to another life.” + “Switching on a light, one I didn’t know, totally alive, totally released.” The atmosphere of the song is so dreamy and meditative. I think the song is about waking up from one phase of your life and transitioning into the next. Looking back and realizing that you’ve been in a stagnant place for so long and a different life that you didn’t see before is actually possible for you. I love the message of the song, the acoustic guitar work is beautiful, and the whole song has the feeling of awakening from a dream. For me it’s a 10/10 track and I just wanted to see if others felt the same.

What is the deal with the FireTEAMS test on the NTN? I live in Florida and I already have my firefighter 2 and EMT certs. I finished all of the courses close to a year ago, and I’ve had some rough personal issues happen in my life which slowed down my ability to continue pursuing certs and jobs with the exception of a couple of interviews which didn’t come to anything sadly.
So I’m trying to catch up and do my CPAT and Fireteams but the fireteams confuses me. I’m required to pick departments I want to work before I can schedule it and then it wants to charge me for even picking them. Is it just that I have to a pick a department for them to send the results to as a formality? Or is it that my fireteams results will only ever be received by that department? I’d on get it.
