2024.11.28 11:00 laskilevy Confused about Dental Negligence Complaint - Do I really need an expert witness at this point?
In Scotland. I don’t really want to go into a ton of detail just yet but I made a complaint directly to my dental practice after some bad work and a subsequent missed diagnosis ended up with some very painful/traumatic emergency treatment over a weekend. I then opted to have the remainder of my treatment to resolve their shoddy work done privately because I did not wish to receive any further treatment from a practice I don’t trust.
I contacted my dentist to make a complaint and request compensation for the costs I’m now paying for the treatment fixing their mistakes, as well as pain/suffering. Today I’ve received communication from the DDU. They’ve requested access to my dental records from the dentists I’ve seen both before and after the one I’m complaining about. I suppose I’m a bit confused that they’re asking for clinical records from previous dentists I’d seen before any of this happened - can anyone explain why that would be relevant to this case?
My main concern, though, is that they have also said the following: “the onus is on you to obtain your own independent expert evidence to substantiate any allegations of negligence.”
I’m quite surprised by this as I didn’t think I would need to obtain (and pay for, which I can’t afford!) an expert witness at this point, particularly when I honestly didn’t think this would need to end up in court or anything like that. I also thought that just seeing the dental records which begin from this experience (which include a note from my dentist that some work was carried out incorrectly/badly) would be evidence enough of negligence without the need for me to obtain an expert? Does anyone have any advice here? Is this just the standard? It seems very clear to me that the people currently investigating my complaint are set up to defend the dentists so none of this feels very impartial to me, but I’m also really unfamiliar with this entire process, so any help would be really appreciated.
