My niece lives in KANSAS. Her exboyfriend is on the violent offender registry for hurting someone else years ago. He had a felony charge for hurting her last year and it was reduced to misdemeanor. Then a couple of months ago he accused he of hitting him with a car. No injuries. He had a friend call up saying he witnessed it hours later. Weeks later a stranger witness came forward supporting her statements that he wasn’t harmed. Anyhow she was arrested the day he claimed this happened and let out on bond. The case has been delayed once by her lawyer and now by prosecutors after the stranger witness came forward. She wants to leave the county. Her family is from another state and she wants to be far away from this abuser and honestly from the county. For example, She was sexually assaulted in jail and they gave her the prea violation because she was wearing a two sizes too small shirt at the time that they issued her. She had asked multiple times for suitable clothing. In addition he bond her mom put up will be revoked if she so much as gets a ticket for a tail light. On a small kansas town she wants out and to go back to her home state.
Is she allowed to or does she have to get her pro bono lawyer that never accepts her calls to file a motion? How hard is it to be able to get away. Since he is registered her ex cannot have and does not have any legal custody to their shared child. He hasn’t filed anything for custody, seen or asked about the kid in two months. Will the fact that there is a kid make it harder to leave? Can she leave the county but stay in Kansas without permission? Also there is a protection order he has against her and kansas isn’t a two way protection order state. She also wants away because at any time he can lie again and say he saw her in the small towns that’s a violation.
Btw it’s her initial hearing that keeps being postponed so no decisions have been made except the bond was paid for her to get out and the protection order is in place.
