Wat ik wel vreemd vind, is dat er verschillende normtijden zijn voor mannen en vrouwen, ook zijn er verschillende normtijden op basis van leeftijd. Nu vraag ik me af of dit mag of dat dit verboden is op basis van artikel 1 van de Grondwet. Er wordt nu namelijk op basis van geslacht en leeftijd bepaald hoe goed je moet presteren, dat lijkt me niet in orde. Vooral omdat hetgeen waarvoor we de test moeten doen, tijdig kunnen ondersteunen in noodsituaties, geen rekening houdt met deze verschillen.
Kan ik deze test weigeren op basis van artikel 1 van de Grondwet totdat deze eisen voor ieder geslacht en iedere leeftijd gelijkgetrokken worden? Of kunnen er zelfs zwaardere juridische gevolgen aan hangen voor de werkgever gezien deze de Grondwet aan de laars lijkt te lappen?
