Hello all, first time posting here. Me and my wife are looking for some guidance on her employment situation. Any help or legal suggestions are welcomed!
So we currently reside in Ontario. I found a new job in Alberta, so we are moving together to there early March.
My wife is working as a legal assistant in one of the law firm in Ontario, and she has been working remotely (work-from-home) with her current employer since 2019. She is now pregnant, and we are expecting the delivery of our little one this year around August. After informing the firm about this relocation, her employer expressed that her employment will end if she becomes a non-Ontario resident. The reason/excuse she received is that “ The Alberta Legislation is different”.
Here’s our questions: 1. Is there such rules or laws that prohibit non Ontario Residents from working remotely as a legal assistant for Ontario law firms?
- Given that my wife is pregnant, can her employer still let go her? What about the maternity leave?
- Based on laws, if she were still let go while being pregnant, what should she receive as the severance / settlement package?
