2024.11.27 23:23 Responsible_Task_885 Advice on serious potential wrongful termination
My previous employer tried to place me on a fictitious PIP, threatened to fire me if I didn’t sign it (which I have an email-forwarded copy of), ignored my complaint that the PIP is false coming from a hostile manager, and rejected my written request to discuss and investigate the PIP with the evidence I had and they stated it was not up for discussion. I was told via email I would be terminated if I didn’t sign the PIP by a certain deadline. While waiting for my signature, they demoted me, restricted my access, and subsequently fired me while I requested investigation. They then told me I would not get my last paycheck until I returned company equipment.
Additionally, I was diagnosed with C-PTSD, Major depression, Generalized anxiety disorder, and suicidal ideation. My employer agreed to 100% telework at the recommendation of my therapist and a letter shared with my employer about my conditions. As a caviat, I was to report to the office 1x/week despite the initial agreement that I would be fully remote. A few months later, I received the aforementioned PIP stating I now must be in-office 5x/week, or I would be let go due to “failure to meet my weekly ‘in-office’ obligation — despite my adherence to PTO request procedure with gained approval while not having any record of write-ups noting “failure to fulfill in-office obligation” prior to the PIP. Additionally, there was “failure to complete responsibilities”. This was strange, because on the contrary, I never received complaints, write-ups, or warnings. My metrics showed improved productivity and performance for the company. The CEO of the company told me that our clients love our work because of what I was doing. I was getting written praise as well as formal praise from multiple supervisors in our performance tracking system up until TWO WEEKS before the PIP. They also added in responsibilities that I “failed” to complete that were not part of my job description in my offer letter nor was I told I was to start doing those additional things.
Additionally, before all of the PIP, my direct supervisor was hostile. We had an intern that I was picking up the slack for, yet, all the credit for my work would he given to this intern in team meetings. a few days before the PIP, she went on PTO for a few days but I didn’t find out until the INTERN told me. She also gave him tasks to do and left me completely in the dark. She would give me contradictory instructions and then get mad at me. She sarcastically made a comment towards me and cut me off multiple times to the point where someone cut HER off and said “wait “x name”, were you still talking?”
Then at some point later, HR and my supervisor said we would do a check-in meeting and that, verbatim, they do this with everyone and it’s just to check in on my goals, how I see myself growing, etc. during the meeting, there was nooooo complaints and everything went well. Then at the end of the meeting they said we just need you to sign a document. It’s a PIP, so just send it back to us. No explanation, no nothing, and didn’t state out that it was a “Performance Improvement Plan”. So I’m like ok cool. (I didn’t know what a PIP was or heard of it). Then I read the PIP and I just feel COMPLETELY blindsided.
When I told the intern everything that happened after the PIP, he was apologetic and said he had noticed something was off but didn’t know what it was. When my unemployment was denied, the Unemployment person told me that if I had an issue, why didn’t I go to HR earlier? And I said I was scared of confrontation and jeopardizing my job. I also struggle with anxiety and she was already being hostile. Then the unemployment person just repeated the same thing. I was getting so upset that I started shaking and just didn’t know what to say anymore and just broke down crying so I just took her advice of contesting the denial. I ended up not doing that, because I was worried about having to defend myself with a mediator.
As the icing on the cake, the employer denied my unemployment claim - stating I was the cause of my own firing despite the fact that they tried to force me into signing a falsified PIP, demoted me, removed my access, and rejected my data and review-based evidence after I requested an investigation, and then fired me after the deadline had passed while I tried to plead for an investigation into the PIP and my hostile manager.
The employer did all of this while knowing of my diagnoses and while I was experiencing suicidal ideation - all of which they were aware of. They then stripped me of my livelihood further and ability to support myself financially by withholding my last paycheck until I returned company equipment and then deceivingly denying my unemployment claim.
I have documentation of EEEEEEVERYTHING. The emails, approval of PTO requests, the chats, the metrics, the written praise, the revoking of my roles so I couldn’t do my job, the written emails where HR told me my PIP was not up for discussion and I need to sign it or I may be terminated, and HR also threatening to withhold my paycheck if I don’t send back my equipment, Every. Single. Thing. Because once they revoked my access until I signed, I knew I had to get all my proof together.
I didn’t file with the EEOC because I was just so traumatized after everything and with my ptsd, depression, anxiety, and the fact that I’ve been homeless before, I just didn’t have the bandwidth or emotional strength to pursue any of it further (especially with how the unemployment person treated me, victim blamed, and disregarded me) even though I wanted to. Just shocked, confused, angry, and so many emotions I can’t even describe - I was so incredibly shaken up. And I know the world can be unfair and cruel, but it feels like a special type of hell when you have to deal with it on top of mental health struggles and the fact that most companies don’t care if you’re struggling in that way. It feels like the most devaluing thing. It’s been a few years now, and I still have time to file a suit.
So guys… do I have legal recourse here? How many violations were committed?

I legit blew up over cooking eggs because my mother chastised me about how my incompetent brother "does everything on his own" and I should cook my own eggs.
Mind you I've just had surgery so it difficult for me to stand and sit for long periods of time(esp since I just spent 4 hours working from home). Was it stupid and did I start the argument (yes) but am i sick and tired of being criticized and compared to my golden child brother (yes).
It was a stupid argument but it really triggered me. Because I've been fiercely independent for the longest time, from youth (doing my own hw/projects, figuring out how to schedule/apply for school applications, etc) but yet it's always never good enough. I pay for my own bills and the families' utilities and do my own laundry, clean the whole house. I do my fair share yet... it always expected of me, but what about my younger brother. Here are the things my parents don't see about my golden child brother. My dad did his hw up until high school in fear of him failing school, my parents paid for his car parking tickets because he always parked illegal at school because he didn't get up on time to find a parking spot, didn't attend our father's funeral because "he couldn't bother to get up early in the morning". Okay so that in the past what about right now as someone in his late 20s- well he is currently a part time server, doesn't help around the house, got a dog but doesn't take care of it, is only paying for $200 towards utilities (cause I argued with him about it and he did it to "shut me up"). But this isn't about him and me to be honest. I genuinely want a better relationship with him but I can't erase the resentment I have towards him. I wish I could put it past me, but it's very difficult when he is never on my side and is just a bystander.
This is about how my mom legit keeps criticizing me yet he is praised for the littlest of things. His bare minimum is legit praised and his word is always the final say, yet the one who has been independent and helped out the family and supported the family is always criticized. Yea I cracked, but I'm so sick of the backhanded compliments and so sick of hearing the praise of someone who quite frankly doesn't deserve it. I'm over the argument but I can't get over the lingering anger, resentment and over the comments and things my mom said. I know I shouldn't care and I should be the bigger person but i genuinely can't. I'm tired of always being the bigger person.

After over a decade I finally updated my outdated monitor to a nice modern 4k dual monitor setup.
However, now I am noticing issues with my TS4. Primarily some sleep wake issues where my macbook seems to wake up and also wake up the monitors and also I come back to my disks being ejected.
Is it better maybe to connect the monitors via DisplayPort? The monitors support both DP and USB-C. Right now I have them connected with 2 Thunderbolt 4 cables but display port would actually be a lot cheaper.
Would DP be maybe less resource intensive or does it make no difference? I noticed my memory is being hogged a lot more now with just one of these 4k monitors connected to the TS4 via thunderbolt 4 cable.
Also, is a mixed setup potentially possible? So 1 monitor connected via TB4, the other via DP? That would at least free up one TB4 port on the back again.

Yes, I have a call into my doctor, but she's taking a while to get back with me. I've had a whole slew of symptoms labeled as severe dysautonomia for the past few months. I've lost massive of weight and I have tons of neurological symptoms, but I passed tilt table test. I have ungodly pressure and dizziness in my head that is so bad. I literally can't sleep. Tons of PVCs/palpitations. Nausea, complete lack of appetite, exhaustion, dizziness, vertigo, constantly shaking, and cold.
I was admitted for a week, had lots of testing done, they sent me home. However, my thiamine results had not come in at the time they discharged me. They just showed up in my lab work today and it said my thiamine level is 7 nmol/l. Everything that I'm searching shows that it should be a minimum of 70. Is that right or is that wrong?
Anyone here have any experience with thiamine deficiency or levels? If it really is that low, I'm debating going to the ER in an hour when my partner gets home.
