I am in process of buying an unregistered ready to move in property in North Bangalore. I have made the token deposit as of now and now engaged with paperwork drafting for Assignment Agreement. I have few questions which is still not clear at my end. I am buying it completely in white. 25% - From my side and 75% - Bank Loan. Q1. What should be step wise payment to seller ? (I have paid 1% as token, Want to pay 23% on signing of Assignment Agreement and 1% as TDS) Q2. Seller is asking, if whole 1% needs to be paid as TDS since he would not be getting the complete money and part of it would be going to builder. Do i have to deduct the TDS based on how much money is paid to each party? Q3. After i pay my part, how would the bank payment work. I have engaged the same bank (SBI) for loan with whom the original buyer has taken the loan. In the original Agreement to Sale, 8% was reserved to be paid on handover / registration to builder. Q4. In case the registration is delayed by few months by builder, what happens during that time, Flat has completed its construction so can i take interim ownership and start interior work? Q5. Any potential red flags to be aware about these kind of deals.
