I want to start this off by prefacing I formed my company +6 years ago through legal zoom and had never had to worry about a trademark until now, nor did I ever think to ask about it because I didn’t even know business names were trademarked (I didn’t grow up in the US).
My company is a service-based LLC and was registered California +6 years ago. At the time, I did a lot of research using the exact business name I wanted to test marketing. Nothing else existed with that name so I went ahead. Let’s call it “ABC Management LLC” for the sake of anonymity. We own www.abcmanagement.com and all social handles with @abcmanagement
A few years ago, a google search made me aware of another company, named “ABC Management Inc.”, in a different state, providing the same exact services. They were quite far down in the Google search so I didn’t think anything of it. My mistake.
Flash forward to the present, “ABC Management Inc” has completely taken over Google search results. Their website, socials (they use @abcmanagementinc, maps location etc all come up and ours were basically erased.
This is a problem now because we work in an extremely competitive industry where reputation is everything and we have hundreds of clients and potential partners googling and finding this other company, which isn’t only confusing but also makes us look bad because of horrible web design, etc.
Not that it matters, but our company seems to be bigger in size and revenue.
I went ahead and filed for a trademark, but I’m aware it can take a year or more to get it. There were no trademarks with our company name.
What’s confusing is their website claims the company was founded in 2010, but I recall no web presence in 2019. Additionally, I’ve done an exhaustive search to try and find their registration in their home state and did not find anything. I did find a registration for an associated non profit under “ABC Help Center” (random example) from 2010, but nothing with “ABC Management”.
Could they be running a business illegally thinking their non profit registration is enough? Registered under a different name? Is there anything I can do in the meantime?

So I haven’t seen a single email sent or received by my attorneys on my behalf, which emails they promised they will forward to me.
I requested to be forwarded their first letter to the defendants/potential defendants and all the emails in my case, and the administrator said they will do it. Well, my request was at the latest in November, and it was actually likely October. Since the administrator said they will send it the next business day and I didn’t receive anything, I asked about it…. and then several times since then since I was getting promised the emails but didn’t get them.
Last week on Monday, I sent the adminstrator a message asking them again for the emails, and I called to follow up and left a message. I didn’t get a response last week. So this week, I called and left a message. The only weekday I’m not busy this semester is Mondays and Fridays, so I asked on Monday if they are open and told them it’s a holiday, and the receptionist said yes, they’re open Mondays to Fridays. And then I got a text saying it’s a holiday and they’ll call me the next day. Of course I haven’t heard or received anything further, although they knew I am busy except for mondays and fridays. But even though they didn’t return my phone call from Monday, they still had since Monday to forward those emails.
This morning, I sent them a written request as opposed to calling. And I asked for an estimate of when they can get it done. I only got an automated response saying they received my email, no answer to my question.
I feel I gave them a lot of grace. Their reasons for not getting it done were that the person who was supposed to forward emails was probably on medical leave; holidays for a month; MLK Day; and that there are a lot of ‘moving parts’ in the virtual office; I interpret ‘moving parts’ to mean staff that they communicate with remotely.
I don’t even know the names of the attorneys who worked on this matter or attended mediation/meetings with the opposing side,!even though I asked the question. The only potential exception is the one attorney/administrator I’ve been talking to. I was given his name, though I can’t find any record of him on the state bar website.
Since I have time tomorrow, I think I’ll call them tomorrow/Friday, plus I want to hear what happened at the latest mediation (which keeps getting postponed/delayed apparently by the opposing side). For sure they can’t have settled the matter without my authorization. Probably the same thing happened as with all the other mediation meetings and not everyone showed up or they postponed it again. This has happened several times now.
Anyhow, it’s gotten frustrating trying to get forwarded the emails. I at least want to see them before the statute of limitations is close to expiring and before ever filing a lawsuit, if that happens. The attorney/administrator seemed eager to have someone forward the emails in OctobeNovember, but lately I don’t know what’s going on.
I was also thinking of writing to them saying I want to be cc’d on all emails sent/received by them in the future on my behalf, so that I wouldn’t have to keep asking for them. But from the little research I did today, the internet advises lawyers not to cc clients on emails. 🤷♀️ So, I don’t know.

Recently I started getting into collectible toys and after encountering the more obvious ones like Funko, Popmart figures, and lots of designer toys, I was left feeling uninterested in much of them. I guess I have somewhat of an idea of what I'm looking for that I'm not finding. The vibe I'm after is figures that are cute/playful but at the same time have a little bit of a dangerous edge to them. A good example of this would be the designer toy brand kidrobot and their various figure colllections. Hi everyone! Just quickly I wanted to figure out how my DUI could affect my citizenship application. I know what I did was wrong and I’m not going to justify/explain what I did but rather give the facts in hope someone has been through a similar situation -
I’m a NZ citizen and I’ve been living in Aus for 10 years. I was caught drunk driving 2 years ago and blew mid range. I lost my license for 8 months and had to pay a fine. It was the first time I’ve done something of the sort other than that there’s nothing else on my record apart from a couple parking fines and 1 speeding fine.
I disclosed this on my application for my citizenship and now I’m wondering what could happen next?
