Hi there, we purchased a Mini from a small business, operated with proper traders licence etc. Advertises through autotrader, and trades from a private property.
We saw the vehicle and it appeared a good deal. We saw it in person and immediately I noticed a knocking sound which I believed to be a water pump issue, which the trader duly noted and offered to get fixed before purchase with MOT and service.
Took car for a test drive around suburban area which is limited to 50mph, but handled well, gears changed fine etc
A couple of weeks later once the work was complete we collected car from trader and filled all the relevant paperwork, which included a warranty with the AA. It's a basic warranty given the age of the car, but he assured us it was worthwhile.
Skip forward approx 2 months and whilst driving the 6th gear popped out mid drive. I tested that my partner should use the clutch better. A few days later I was driving when despite not touching the clutch pedal, the car dropped out of 6th gear. My partner gave me the knowing look of "hows using that clutch?"
We contacted the trader as we'd only had it 2 months. He directed us to the warranty, which AA now wanted a specialist inspection of the gearbox - ie take apart to see what's wrong.
The vehicle is low mileage (74k 10year old car) so I don't feel it would be excessive usage, but I appreciate it don't know the driving habits of previous owner!
The gearbox had now been assessed and will cost £1400 to repair, less the £500 covered by warranty.
We went to CAB (citizens advice) who recommended we send this-
You're legally entitled to a repair if something goes wrong with the car. Because you bought the car in the last 6 months, the law says it must have been faulty when you bought it. If the trader says the car wasn't faulty when they sold it to you, it's their responsibility to prove it. Please provide evidence that the gear box was checked and was proven to not be faulty when you sold me the car.
He has responded saying he will send evidence for this.
Now finally to the point- if to get the warranty providers to understand fault we had to split the gearbox, surely for him to have checked the fault was not existing when we purchased it, he too would have had to do same level of investigation and simply getting an overall view, like we did when purchasing, would not be enough evidence? And if so, would he still be liable as the fault occurred within such a short time so we had not caused wear and tear in the 2 months of ownership (we have the service mileage and current mileage to show low useage).
